Terms & Conditions Of Template Usage

Definitions

Price Tapestry Templates and Price Tapestry are seperate entities and are owned by seperate people. These terms apply solely to Templates purchased from Price Tapestry Templates.

General

General terms apply to all templates sold, irrespective of type. These are in addition to the conditional template-specific terms found below.

  1. All Templates sold at PriceTapestryTemplates.com are designed only for use with Price Tapestry. Please do not buy Our Templates if You do not have a valid Price Tapestry licence or if You are not running Price Tapestry on any of your websites.
  2. A payment via PayPal or Google Checkout does not constitue acceptance of your order. We reserve the right to cancel and refund your order if we feel it neccesary to do so. Reasons include, but are not limited to, suspicion of fraud, falsified payments and partial payment.
  3. Template support is offered via email only. Please direct Template questions to Us and Script questions to the Price Tapestry forum.
  4. You are free to modify the Template in any way you wish so long as it does not breach these terms and conditions, nor the terms and conditions of the Price Tapestry software.
  5. Installation instructions are provided on our website and in every download. Installation is very simple.
  6. We only recommend installing Our Templates onto a fresh installation of Price Tapestry as some of our files may overwrite changes you have made to Price Tapestry. Always make a backup before installing any third party Templates or modifications.
  7. We cannot be held responsible for any loss or damage caused by installation or use of Our Templates. Whilst they are fully tested and work for us, a minor proportion of users may experience some problems.
  8. Due to the nature of Our Templates in the sense that they are consumed as soon as they are downloaded, refunds are generally not offered. Refunds are only granted if You have given Us every opportunity to rectify any issues You may have. We only offer refunds if the template does not perform as described on Our website. Refunds are at our discretion and can only be granted up to 15 days after the transaction took place.

Premade Templates

A "Premade Template" is a ready made Template available for general sale via the Price Tapestry Templates website. The following terms apply to such purchases in addition to the General Terms above;

  1. All Premade Templates sold by Us are copyright to Us. By purchasing a Template, you are simply purchasing a licence to use it. You are not purchasing sole rights or copyright or ownership of it. Copyright will remain with Us.
  2. You may use Our Templates on as many sites You own once you have paid for a licence. Licences are non-transferable. You may not redistribute any of our templates. If you sell any of your websites that run our templates, the new owner must not be given the Template files unless he or she purchases a new licence from Us.
  3. By purchasing a licence, you are licencsing the specific version of the Template you download. You are not eligible for free upgrades if the Template is modified, updated or upgraded by Us at a later date. To obtain the latest version You must purchase another licence at the price displayed on the website at the time of purchase.
  4. Premade templates can be downloaded from our website once payment has been approved by Us. We manually check all orders to make sure no fraudulent details have been used. If in doubt, we will refund the transaction and cancel the order.
  5. We can take up to 48 hours to approve payment of an order. If after this time You have not received Your download link, please contact Us.
  6. Your download link will stay active for 7 days after your order is authorised. You can download the Template up to 5 times in this 7 day period. We recommend you download one copy and archive it on your computer in case you need a fresh copy of our template after 7 days.
  7. After 7 days or 5 downloads (whichever is soonest) We cannot send you the Template files you have purchased a licence for if you lose them or request a copy of the Template files. In order to retrieve the template files You will need to purchase a new licence.

SiteMatch Templates

A "SiteMatch template" is a template designed specifically for you to match a current, non-Price Tapestry based design. It is a Template not available for purchase on Our website. The following terms apply to such orders in addition to the General terms.

  1. By paying for an order, You agree that the design You are requesting is not copyrighted to anyone else other than You, and that We will not be held liable for any legal action that arises between You and third parties with regards to breaches of copyright.
  2. We can design customised Templates upon request. The way this works is:
    1. You pay Our asking price, supplying the URL of the design to be replicated in Price Tapestry format
    2. We will create the Template and then upload it to a private website where you can see the result.
    3. When You are happy with the result, or We deem to have met your requirements, We will email You a ZIP file to install the Template onto Your website.
  3. Full copyright of the "SiteMatch Template" will be passed to You upon completion. We will not re-sell your template in full whatsoever. We reserve the right to use elements of Your Template in other Templates We sell.
  4. Once the order has been completed, any further requested changes to the Template You would like Us to make will be charged for.
  5. Due to the nature of the work being completed, we cannot issue refunds on customised work.

FTP Terms and Conditions:

  1. If You request us to install your template for You (at cost), We will need the following data from you:
    • Your FTP address (normally a variation of ftp.my-website-address.com)
    • Your FTP username
    • Your FTP password
  2. We will request You supply this data via email. Please note that this data is not encrypted and You send it at Your own risk.
  3. We will advise You when the work is completed, at which point We dispose of Your FTP data and We recommend You change Your FTP password. Your web host will be able to help You with this.
  4. We cannot be held responsible for any loss or damage to Your website or web host whilst We have Your login credentials. You accept that if You request installation of a template, You send your data at Your own risk.
  5. We will never distribute your FTP login credentials to any third parties. We solely use it for installation of a template. Once We have installed a template, We dispose of Your data. Should You require Us to do any further work, We will need to request the login information again.
  6. As a security measure, You should never give anyone (other than Your website developer or in this case, Us) Your FTP login credentials. If You do, once the work is completed, You should change the FTP password immediately to prevent any unauthorised access.

Disclaimer:

  1. We endeavour to keep product information up-to-date and correct. Any reliance you place on such information is therefore strictly at Your own risk.
  2. In no event will We be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of or in connection with the use of Our Templates.
  3. Every effort is made to keep the website up and running smoothly. However, We take no responsibility for and will not be liable for Our website being temporarily unavailable due to technical issues beyond Our control.
